These Terms of Use constitute a legally binding agreement between you, either personally or on behalf of an entity ("you") and FASTTRADING, 13201 WENTWORTH ST, ARLETA, CA 91331-5823, USA ("Company", "we", "us" or "our"), regarding your access to and use of the https://www.Wohairs.com website and any other form of media, media channel, mobile website or mobile application linked, linked or otherwise connected to it (collectively, the "Site"). You acknowledge that by accessing the Site, you have read, understand and agree to be bound by all of these Terms of Use. IF YOU DO NOT AGREE TO ALL OF THESE TERMS OF USE, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.

Framing

We reaffirm our commitment to the protection of the data of its customers and visitors to this site. Thus, in accordance with the provisions of the General Data Protection Regulation (GDPR - Regulation [EU] 2016/679 of the European Parliament and of the Council of 27 April 2016) on the protection of individuals with regard to the processing of personal data and on the free movement of such data, we have revised the Terms and Conditions of Use of our online store, as well as its Privacy Policy. The new version of these texts will come into effect today, May 25, 2018.


Introduction

Sales made through the online store www.Wohairs.com assume that the customer accepts the General Conditions of Sale, which are established according to the legislation applicable to the e-commerce sector.

We reserve, however, the right to modify these General Conditions of Sale without prior notice, undertaking to publish on this website any modification.

We will not assume any responsibility for any fact arising from the unavailability of the site, regardless of the duration, and also reserves the right to restrict access to certain parts of the site, for technical reasons or under legal obligations.



CONCEPTS AND DEFINITIONS
Customer - any natural person of at least 18 years of age who creates a customer account and undertakes to provide true, complete and current information relating to his or her identification and any other data necessary for the completion and processing of the order in question. For all purposes, we consider a legal entity to be identified and individualized by the connection between its business name, its registered office and its legal entity identification number indicated when creating the respective customer account.



Cookie - a small file sent to the customer's computer that remains stored on the customer's hard drive.

By creating an account on the site, the customer's computer will keep a cookie that will allow the automatic identification of the customer each time he/she returns to the site.

Cookies are also used so that our system can track the steps taken by the customer during a shopping session. If the customer does not accept the use of cookies, he or she will not be able to use this site.



Personal data - information relating to the identified or identifiable natural person, i.e. the "data owner", who can be identified directly or indirectly by reference to an identifier (e.g. name, identification number, e-mail address, IP, among others).



Intellectual Property - all intellectual property rights in software and content made available through this site are owned, licensed and protected by law, and are processed worldwide.

All such rights are reserved to us and our suppliers.

The customer may save, print or display the contents of this site for personal use only.

The publication, manipulation, distribution or representation, in any form, of any of the contents of this site or any connection between such contents and any business or enterprise is not permitted.

Data processing - any operation or set of operations, whether or not carried out by means of automated processes, applied to personal data, such as collection, recording, organization, storage, adaptation or modification, retrieval, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, as well as blocking, erasure or destruction

PURPOSE
The purpose of these Terms and Conditions of Use is to define the conditions for accessing and browsing the site on the part of the customer who wishes to make purchases from the online store. The General Terms and Conditions of Sale are intended to regulate the terms of operation of the commercial transactions carried out between us and the Customer. The Privacy and Data Protection Policy aims to identify the privacy protection measures with regard to the processing of personal data and the free flow of data of natural persons, including tools for personalized management of personal data provided by customers.

I - General terms and conditions of sale

Order and purchase process

For purchases made on its online store, Wohairs offers the following payment methods available:

CREDIT CARD
It is possible for the customer to use a credit card and take advantage of the speed of transaction and flexibility offered by this payment method. All transactions on our site are secure.

Is the online payment by card secure?
Our site is equipped with a sophisticated mechanism to detect and prevent fraudulent practices. This innovative solution allows us to verify the authenticity of payments made online while safeguarding the integrity and security of the data provided by customers and protecting their identity.

Security is ensured by SSL (Secure Socket Layer) technology which encrypts communications between your computer and our server so that they cannot be intercepted. Thus, we reserve the right to refuse any order if the transaction is considered illicit. The competent authorities will be immediately informed of any activity considered illegal.

3D Secure
3D Secure is a communication protocol that improves the security of payments made via the Internet and verifies the identity of the credit card holder with the issuing bank. When you make a payment in an online store, a process is initiated to verify the validity of the card used. If this is the case, the security systems associated with the 3D Secure protocol verify the identity of the customer by contacting, in real time, the bank that issued the credit card. The bank validates the identity of the customer and informs the merchant's system of the validity of the card used for payment.

The objective is to benefit all parties involved by minimizing the probability of fraudulent use of credit cards and optimizing the transaction to be carried out. This protocol is used by Visa under the name Verified By Visa and by Mastercard under the name Secure Code.

How is the payment made by credit card?
After selecting the credit card payment option and clicking on the "Checkout" option, the customer is redirected to the secure payment platform, where the credit card data must be inserted, including the credit card number, expiration date and security code. Finally, simply click on the "pay order" button to complete the transaction.

If the payment is not accepted, an error message will appear in the shopping cart window. In this case, it is recommended to try again. If the problem persists, we advise the customer to contact their bank or the entity that issued the credit card for more information.

Once the payment is finalized, the amount will be charged to the customer's credit card. If, for any reason, it becomes necessary to cancel all or part of the order, we will refund the corresponding amount within a maximum of 5 working days. The transaction will appear on the customer's credit card statement after 2 business days from the date the refund was made.

To protect our customers from potential fraud, we may request additional information to help evaluate the payment. If we do not receive a response within 3 business days, we will cancel the order and issue a refund.

Please note: Payments are always charged in Euros, even if prices are displayed in other currencies. Some banking entities may charge exchange rates. We are totally unaware of this and should not be held responsible.

PAYMENT BY BANK TRANSFER
It is strongly recommended to indicate the reference order number on the bank transfer and to send a proof of payment to our Customer Service to speed up the identification of the payment and the processing of the order.

Any bank charges claimed by the customer's bank are at the customer's expense.

The products are put on hold for 6 days. If the payment has not been received by us during this period of time, the order will be automatically cancelled.

SHIPMENTS
We will ship the customer's order on the day within 48 hours following the payment used: credit card, bank transfer.

If the customer chooses to pay the order by bank transfer, we will only be able to ship the package once we have received confirmation of the payment from our bank, which can take up to 7 working days, depending on the country of origin of the transaction.

* The above mentioned payment methods are not available in all countries. To find out which payment methods are available in your country, the customer should read the information available above, under the heading "Payment Methods".

In the event of a problem with the order (confirmation of the delivery address, verification of payment, unavailability of products, etc.), we will contact the customer by sending a message via the Customer Service. The customer will have to give us an answer within three working days. The order will not be shipped until we receive a response to our message. If no response is received within the specified time, the order will be cancelled and refunded.

SHIPPING
When the order is shipped, the customer will receive the tracking number by e-mail. Thanks to this number, he will be able to follow the evolution of his parcel on the carrier's website.

The customer will also be able to access this order tracking link by logging into their customer account and clicking on the "Orders" tab on the login page. By clicking on an order in the "Order History" column on the left side of the screen, the customer will have access to all the information about that order (including the link mentioned above) in the "Order Details" column on the right side of the screen.

It is possible that at the time the shipment confirmation with the tracking number is sent to the customer, the order tracking does not give any result yet. After receiving the shipment confirmation of the package by email, it takes about 24 hours for the tracking updates to be available on the carrier's website.

Orders are delivered between 08:00 and 19:00, Monday to Friday, to the delivery address indicated by the customer.

The customer can receive the order at the delivery address of his choice (except for post office boxes). It will be enough that he indicates us an address to which he will be present between 9:00 and 19:00. The chosen carrier will try to deliver the order to the address that the customer has indicated.

ATTENTION: The customer cannot choose a specific time of delivery because the deliveries are conditioned by the routes defined by the carrier at the time of delivery.

An erroneous or incomplete address may cause the package to be returned to us, resulting in additional costs that will be charged to the customer. Therefore, we recommend that the customer always make sure that the delivery address given when placing the order is complete and accurate. Once the order has been confirmed, it is no longer possible to change the delivery address or the billing details.



DELIVERY TIMES
Standard delivery

Once the customer's order has been shipped, we guarantee a delivery time of 7 to 10 working days.

PLEASE NOTE: Delivery times are indicative and should only be taken into consideration when there are no physical or structural obstacles to delivery, such as incorrect delivery address or factors beyond our control (strikes, missed flight connections, bad weather conditions, etc.).

SHIPPING COSTS
Shipping costs are calculated automatically by our system, based on the following factors



the actual or volumetric weight of the package (whichever is greater) ;
the total amount of the order;
the carrier's rates which are updated periodically.
Shipping charges are updated as the customer adds or deletes items from the shopping cart.



ORDERS RETURNED TO SENDER
When an order is returned to us for reasons not attributable to us or the carrier service, we will refund the amount of the order minus the shipping and return charges.

The customer can choose to be reimbursed by the method of payment used, or with a reimbursement coupon that can be used on a future order. This coupon will be valid for a period of 12 months, from the date of its creation. After this period, no further refunds can be made. In cases where payment was made by bank transfer, the customer will have to provide the necessary bank details for the refund to be made.

If the cause of the non-delivery and return of the order is the responsibility of the carrier's service, regardless of the method of payment chosen, the customer must send us a written complaint, which will be submitted for analysis by the carrier's service. If the delivery problem is due to an incomplete or incorrect delivery address, we ask for proof of the customer's address to be attached to the complaint (e.g. a gas, water or electricity bill).

The solution we present to the customer will depend on the answer provided by the carrier's service. Therefore, in the case of carrier service claims, we can only present a solution to the customer once the carrier service has provided us with their assessment. If the carrier service accepts full responsibility for the return of the package, and if all the products originally ordered are still available, we will offer the customer a replacement order at no additional charge. Instead of receiving a replacement order, the customer may also choose to receive a full refund. If the carrier's service is not responsible, we will not be able to accept the claim, and therefore we will not be able to send a replacement order. Refunds will be subject to the terms mentioned above for orders returned for reasons not attributable to us or the carrier service.

ORDER CANCELLATION
The customer can cancel his order directly from his account if it has not been paid yet and is not already being processed. If these conditions are met, the customer simply logs into his or her account, clicks on "My Account", then on "My Orders". In the "Order History" column, the customer will be able to select the order they wish to cancel and all the information regarding that order will appear in the "Order Details" column. At the bottom of this section (it may be necessary to scroll down), the customer can click on "Cancel Order". Once the order is cancelled, the customer will receive a confirmation message.

Cancellation of an order is only possible through the procedure described above. Any request for cancellation made by any other means will be refused.

RETURNS
If the customer wishes to return one or more products, he/she may do so within 14 days of receiving the order, provided that the products are intact, closed, complete and in the original packaging of the order. The packaging must be intact, without any modification or scratches. The customer must ensure that the returned items are received at our facilities within 28 days from the date of delivery of the order.

To make a return, the customer must contact our Customer Service Department, indicating the number of the order in question, as well as the description and reference of the products he/she wishes to return, specifying how the refund should be made. The refund can be made either by the original method of payment or in the form of a refund coupon valid for 12 months after its creation date. After this period, no refund can be made.

The customer must also check whether the returned product was purchased as part of a promotional campaign, and whether a free product was offered in this order following the purchase of the product. If this is the case, the product in question must be returned along with the product that was added free of charge. Both products must be returned in accordance with the above guidelines.

A package consisting of various products can only be returned in its entirety. If the customer wishes to return a product that is part of a package, all products in that particular package must be returned. All products in the package must be returned according to the above guidelines.

It is the customer's responsibility to ship the item(s).

Incomplete or damaged products, not having their original packaging and/or label or already used will not be accepted.

We also do not accept returns of products with an expiration date of less than one month.

If we receive an item that does not comply with the above conditions or with the carrier's label stuck directly on the packaging, the customer will lose the right to a refund and will have 10 days to arrange for collection of the item(s) at our facility, with the corresponding shipping costs being at the customer's expense.

EXCHANGES
The customer will have to return the article(s), ask for their refund and then place a new order.
All the procedure of return is described in detail in the paragraph RETURNS.

METHODS OF REFUND
We will do everything in our power to refund the customer as soon as possible. However, we are entitled to a maximum of 15 days, from the day the returned product arrives at our premises, to make the refund.

If payment was made by credit card, the refund will be issued to the account associated with the credit card used for the initial payment and will appear on the customer's next bank statement. *

The customer may also choose to receive a refund in the form of a discount code, regardless of the method of payment originally used. This discount code is valid for 12 months from the date of issue. After this period, no refund can be made.

REFUND OF SHIPPING COSTS
In the event that we are responsible for the return of the order, we will refund the corresponding shipping costs (for example, if the products are defective or if the products sent are not those ordered).

However, if an order consisting of several products contains only one defective product, the shipping costs will not be refunded.

REFUND OF SHIPPING COSTS

There are three situations in which it is possible to raise the issue of refunding the shipping costs of an order:




i) Non-delivery of the order for reasons attributable to us or the carrier: the customer will be fully refunded the amount he/she may have paid as shipping costs. An employee of our customer service department will contact the customer to confirm the right to reimbursement of shipping costs and to provide any additional clarification on this matter.


ii) An error in the product(s) shipped or the shipment of defective product(s): the customer will receive a full refund of the amount he/she may have paid as shipping costs, only if the error or defect is found on all products shipped. For more information on this subject, see point 1.7. below.


iii) Right of withdrawal: in accordance with the provisions of Articles 9 and 11 of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 applicable to contracts concluded at a distance and away from business premises, the customer may exercise his right to withdraw from the contract within 14 days from receipt of the product ordered or, in the event that the order consists of several items delivered on different dates, from the date of delivery of the last item received. In order to exercise this right, the customer must send us an unambiguous declaration of withdrawal before the expiry of the above-mentioned period. We will reimburse the full amount that the customer may have paid as shipping costs. An employee of our customer service department will contact the customer to confirm the right to reimbursement of the shipping costs and to provide any further clarification on this matter.


1.4 Product Information

We take every measure to ensure that all product details, descriptions and prices on our site are correct. Nevertheless, it may happen that product information, including prices and promotions, is not published correctly. In these cases, we reserve the right not to process orders that include these products. If a customer places an order for these products, they will be contacted by our Customer Service Department and informed that the order cannot be processed.

Orders may also be cancelled for other reasons, such as:



product being out of stock
inability to obtain payment authorization
Suspicion of a fraudulent order


All products, campaigns, promotions and offers are limited to the stock available and/or the stock allocated to the campaign in question.

If the customer has chosen to pay for the order by credit card, and if the order contains a product that is no longer in stock, the product will be removed from the order and the other products will be shipped, so as not to delay the process. If the order contains one or more products that are part of a package, the package will be removed entirely from the order. The customer will always be informed of the changes made. A refund to the original payment method will be made immediately. The customer will be informed by the Customer Service team both about the changes made to the order and about the timeframe for the refund.

In the case of payment by Bank Transfer*, if the order contains a product that is no longer in stock, it will be removed from the order and, after contacting the customer and obtaining confirmation from him/her, we will ship the remaining products. If the order contains one or more products that are part of a pack, the pack will be removed from the order entirely. If the order contains one or more products that are part of a pack, after contacting the customer and obtaining confirmation from him/her, this pack will be completely removed from the order. The refund will be made immediately in the form of a coupon, valid for 12 months from the date of its creation. After this period, no refund can be made. The customer will receive a message from our Customer Service regarding the changes made to the order and the code of the coupon created. If the customer prefers a refund via the original payment method, he/she can request it by replying to the Customer Service message, sending the refund coupon code and all the bank details of the account to which the refund is to be made (bank name, IBAN and SWIFT).

* The above mentioned payment methods are not available for all countries. It is necessary to consult the information under "Payment methods" to know which payment methods are available in the customer's country.

We reserve the right to change prices without prior notice.

1.5 Suggestions and Complaints

The opinion of our customers is very important to us, as it allows us to improve our services. Therefore, if for any reason our customers are not satisfied with our services, or if they have any suggestions, we would be grateful if they would take a few minutes to report the problem, preferably by sending a message to our Customer Service team.

If the complaint is related to a particular order, customers have 14 days from the date of receipt of the order to contact our Customer Service team and report the problem detected.

If the customer receives a defective or damaged product, or if the product received is not the one ordered, the complaint must be accompanied by some photos clearly showing the problem detected, as well as the condition of the box in which the order was delivered.

The customer must keep the defective, damaged or exchanged product in his possession, as well as the box of the order, until further notice from our Customer Service team.

If the outside of the box is not in perfect condition at the time of delivery, the customer may reject the order, failing which a subsequent claim may not be accepted.



1.7 WARRANTY
As one of the fundamental rights of the consumer is access to goods and services with guarantee, we guarantee the quality of its products for a period of 24 months from the date of purchase (except for perishable goods). If it turns out to be legitimate, we will offer our customers one of the following solutions, listed in order:

Repair of the good with a guarantee of its correct functioning and/or quality
Replacement of the good
Replacement of the good with another with the same characteristics and purpose, after obtaining the customer's agreement
Cancellation of the contract leading to a refund, if none of the above options is possible


In order to exercise the right of guarantee, the customer must always file a claim with our Customer Service team and return the goods that do not work properly or do not correspond to the item purchased.

Our Customer Service team will check the item(s) in question to confirm the validity of the warranty claim filed by the customer. This excludes all situations that may arise from:

Misuse, intentional damage or negligence of the customer;
Normal wear and tear of the goods, as provided for in the information supplied by the manufacturer;
The impossibility of proving the defect or failure indicated by the customer;
Any suspected fraud situation.
After inspection of the goods, the customer will be informed of the follow-up of his request and the procedures to follow.

Once the warranty claim has been accepted, we will repair, replace or refund within a maximum of 30 days from the date on which the warranty claim for the defective item has been confirmed in writing and via e-mail.

In the event of a refund, it will be made by the same method of payment used at the time of purchase, unless the customer agrees to the refund being made in another form.

These measures do not affect the consumer's rights under current law.



II - Privacy and Data Protection Policy


2.1 Introduction

Browsing our website and registering as a customer of the online store implies the understanding and acceptance of this Privacy and Data Protection Policy.

We are constantly concerned about the protection of personal data confidentiality and we put into practice preventive measures regarding the security of the site and the protection of the data of its customers and visitors.

In order to strengthen the guarantees of confidentiality of personal data, new measures of data protection have been taken, in terms of verification of the legitimacy of the use of personal data processed, and in terms of guaranteeing the respect of the rights recognized to the holders of such data. Within this framework, and through the specialization of customer service channels, we aim to promote a clearer and more objective communication of the purposes underlying the processing of personal data and the transparency of the processing operations of said data.

Thus, the information in this document aims to convey, in a clear and unmistakable way, the content of the privacy policy and protection of personal data that will be subject to processing in accordance with the provisions of the General Data Protection Regulation (hereinafter referred to as "GDPR") and according to delimited by the content of the business relationship to be established between the data holder and us.



2.2 Types of personal data collected

In general terms, personal data is collected in three situations arising directly from our activity:



2.2.1. User registration: creation of the customer account and data processing purposes

For the creation of the customer account, there is a personal area where the customer must introduce the data necessary for identification as a customer. The completion of the first order will depend on the transmission of additional personal data, essential for the processing of the respective order and delivery.

Required fields in the forms for customer registration are marked with an asterisk (*).



We are committed to protecting the customer's data; it will never be made available to third parties without the knowledge or consent of the owner, as required by law.

During the processing of the customer's order, it is possible that some personal data (such as address and postal code) may be transmitted to third parties for the sole purpose of preventing and detecting fraud and always following the interpellation for this purpose by the competent authorities.



Furthermore, when a purchase is made on the site, data concerning the delivery address and payment details will also be requested, in order to guarantee greater efficiency and the respect of delivery times.



The data transmitted will be recorded for the period of time strictly necessary, which normally corresponds to the period of existence of the customer account. For this reason, when the customer deletes his or her customer account, the personal data will be permanently deleted, with the exception of the data necessary to comply with legal obligations, which will be archived in a database for this purpose and for the period of time that is strictly necessary. In the event that the customer wishes to place a new order on the site, the customer will have to register again and will be subject to the terms and conditions in force at that time.


We may also collect other information about the customer's experience on the site for the sole purpose of improving the service provided to the customer, which we will do after confirmation of knowledge and, where appropriate, after the express consent of the holder of the personal data.
The conclusion of the customer's registration will trigger a confirmation of registration to the e-mail address that the customer has associated with his customer account and which will include a link to this text.

With regard to the updating of customer data, when the customer wishes to check the data provided to us, he/she can do so in his/her personal area. The customer must keep the access data to his account safe, since any action or request made through the account will be his responsibility, as long as the procedures for validating the customer's identity described below have been followed.

We recommend that the customer does not save their password on the browser, as someone else who has access to their computer can access their personal information.



What is the purpose of the data collected?

The customer's data is processed in order to carry out actions such as processing orders, notifying the customer about possible changes applied to the site's features, conducting surveys and evaluating interactions for statistical purposes.

We may also periodically send the customer information by e-mail about products and services, campaigns, promotions and special offers. If the customer does not wish to be contacted for these purposes, he or she may unsubscribe to the newsletter by clicking on "opt-out" in the Manage Authorizations tab of the account data area or by clicking on the link in the text of the newsletter to that effect.



2.2.2. Customer contact with us

When the customer, on his own initiative, contacts us in order to obtain information on the products, on the purchase process, on the status of the order or to report any situation related to the site, we may need to collect additional personal data for different purposes that will be, in the particular case, specifically communicated but that may fall generically in one of the following situations:

i) to confirm the identity of the customer and the reason for the contact.

In order to ensure that the contact is actually made by the data holder, we have put into practice measures to strengthen the confirmation of the identity of the interlocutor for cases where the contact is made by telephone.

Thus, from May 25, 2018, the operator will only continue the call after clear and objective communication of the purposes and conditions of the validation of the identity of the customer and the express confirmation on the part of the latter of the intention to continue the contact, safe from these conditions.

In this context, it is possible that the customer will be asked, for example, to indicate one or more products purchased in previous orders indicated in the order history of the last 6 (six) months, which the operator will access after asking the customer's authorization.

Alternatively, and after the description of this identity validation mechanism, there is the possibility of sending, to the telephone contact or e-mail address registered on the customer account, an alphanumeric validation code that the customer will have to transmit to the operator at the beginning of the call.

After validating the customer's identity, the operator will ask key questions based on the description of the reason for contact, in order to establish a context for the situation and, if necessary, redirect it to a customer service employee specialized in the subject to be dealt with.

The possible recording of the call for the purpose of evaluating the quality of the service will depend on the express and prior consent of the customer.

ii) inform the customer of the fact that a message has been sent to the message box of his customer account, due to an out-of-stock condition of one or more items of the order in question and that, as an alternative to the unavailability of the product, it is possible to make a refund of the amount paid or to replace the items with similar products, in accordance with the provisions of point 1.4 of the General Terms and Conditions of Sale
